Mistrial declared in Brookhaven FedEx shooting trial
SUMMARY: A mistrial has been declared in the trial of two white men who are accused of chasing and shooting at a black FedEx driver in Brookhaven, Mississippi. Brandon Case and his father, Gregory Charles Case, were indicted on charges of attempted murder, conspiracy, and shooting into the vehicle of D'Monterrio Gibson. The judge declared a mistrial after it was discovered that a tape from a police detective should have been turned over in pre-trial discovery. The defendants claimed that they followed Gibson to obtain a tag number after reporting a trespasser on their property. Gibson's attorney compared the incident to the killing of Ahmaud Arbery. Gibson is still employed by FedEx but is on workers' compensation leave. A federal lawsuit filed by Gibson seeking $5 million from FedEx was dismissed, and his attorney plans to file a new civil suit in state court.
