Mississippi AG spearheads lawsuit against federal LGBTQ+ anti-discrimination rule
SUMMARY: Mississippi Attorney General Lynn Fitch and Tennessee AG Jonathan Skrmetti are leading multi-state litigation against a new federal rule from the U.S. Department of Health and Human Services (HHS). The rule prohibits discrimination based on gender identity, mandating that medical providers perform gender-affirming care for minors or face severe penalties, including potential loss of Medicaid funding. Fitch argues the rule imposes political agendas on medical practices, disregarding medical judgment. The lawsuit contends the rule forces providers to accept patients in spaces based on gender identity and use gender-affirming pronouns. Republican-led states, reminiscent of a 2016 challenge, are optimistic about overturning the rule.
