Judge upholds medical marijuana restrictions in Mississippi
SUMMARY: A federal judge dismissed a lawsuit claiming that state regulations forbidding dispensaries from advertising in most media is censorship. Mississippi officials argue that dispensary owners do not enjoy constitutional protections for commercial speech because marijuana possession is illegal under federal law. The judge agreed with this argument. Mississippi legalized medical marijuana for certain conditions in 2022, and Clarence Kroof II opened a dispensary in Olive Branch. However, he says he has struggled to reach customers because of these advertising regulations.
