Closing arguments: Defense
SUMMARY: Good morning, instructions have been given for four counts relating to an incident on November 1st, 2008. The state must prove liability in the case, including the issue of who had the right of way. A reconstruction expert testified about the traffic signals. The state also has to prove the defendant's blood alcohol concentration at the time of the incident. Failure to prove any of these elements beyond reasonable doubt means the state may not have met its burden. The defense argues that the state has not proven the defendant's guilt.
