U.S. Fifth Circuit allows Capitol Complex Improvement District Court to move forward

SUMMARY: The 5th U.S. Circuit Court of Appeals denied the NAACP’s motion for an injunction regarding House Bill 1020, which would create a state-run court in part of Jackson, Mississippi. The court would be part of the Capitol Complex Improvement District (CCID), created by the mostly white and Republican-controlled Mississippi Legislature. The NAACP sued on behalf of Jackson residents, arguing that the new court undermines democracy by not allowing local voters or elected officials to choose its judge or prosecutors. The court said that the plaintiffs did not have standing to assert their claims and that the state law does not take power away from local officials. The NAACP plans to continue its legal fight.
