What to do if your landlord keeps your security deposit
SUMMARY: When moving out, many plan to use their security deposit, but landlords sometimes withhold it without explanation. Texas law mandates landlords return deposits within 30 days, providing an accounting if any amount is withheld. A renter named Siobhan faced unexpected charges for cleaning despite leaving her apartment in good condition. To protect themselves, renters should document their apartment’s condition upon moving out, send their forwarding address to the landlord, and request their deposit back. If landlords violate the law, a certified letter can prompt action, and small claims court may award tenants three times their deposit plus $100 if damages aren’t proven.
Moving out and not getting your security deposit back? KPRC 2’s Amy Davis explains what steps to take if your landlord keeps your money without a valid explanation. Learn about your rights and how to resolve disputes when it comes to reclaiming your security deposit.
