Smith was in bed when an officer fired several bullets at a suspect running through her apartment complex, with one bullet entering her apartment and striking her arm. Smith sued Mississippi Public Safety Commissioner Sean Tindell and Capitol Police Chief Bo Luckey, alleging violations of her constitutional rights. However, the judge ruled that Tindell and Luckey cannot be held liable as they did not participate in the shooting incident and state officials cannot be sued for state law violations in federal court.
