Legal Lens: Keeping paths clear during winter weather
SUMMARY: Frustrations in the St. Louis area are rising due to icy roads and sidewalks. Attorney Andrea McNairy explains the legal responsibilities for snow and ice removal, noting that in Missouri, landlords are generally not required to clear it unless specified in the lease or if they have consistently done so in the past. Tenants should always check their lease for details. For homeowners associations (HOAs), failing to fulfill snow removal duties may result in breach of contract claims. However, legal recourse against municipalities for icy roads is limited, as they have protections against liability, especially during snow events.

This year’s winter storm has left more than a mess.
Legal questions have surfaced over the responsibility of keeping streets and sidewalks clear. Brown & Crouppen attorney Andrea McNairy answers some of the questions FOX 2 viewers have been asking.

Belleville asking residents to park on one side of street or driveway ahead of snow
SUMMARY: The City of Belleville is urging residents not to block snowplows during snowstorms, as parked cars can hinder plows and first responders. The city requested that residents park on one side of the street or in their driveways before snow begins. Local hardware stores are seeing an increase in winter supply purchases, with items like pet-friendly ice melt selling quickly. The City of St. Louis plans to treat roads with a salt solution and deploy 50 plow trucks as needed. Some Belleville residents are ready for spring, with weed killers already being prepared for the upcoming season.

Belleville residents Carrie Dyson and Dorion Douglas were buying ice-melting products at the West Belleville Ace Hardware on Friday, and they’re not looking forward to the possibility of snow next week.

West Virginia leads 22 states suing over New York Climate Change Superfund Act
SUMMARY: West Virginia is leading a lawsuit against New York’s Climate Change Superfund Act, which mandates polluters to pay for environmental damage according to the fossil fuel emissions they generated from 2000 to 2018. Attorney General John McCuskey claims New York is overstepping by penalizing out-of-state companies. The law imposes up to $75 billion in penalties over 25 years. Critics argue that it unfairly disrupts interstate commerce and creates unnecessary costs for consumers. Supporters of the act emphasize the need for accountability from fossil fuel companies for their role in climate change. The lawsuit has garnered support from 21 other states.
