Florida appeals court strikes down state’s open carry ban
SUMMARY: A Florida appeals court has struck down the state’s decades-old ban on openly carrying firearms, ruling it unconstitutional under the Second Amendment. The First District Court of Appeals reversed Stanley Victor McDaniels’ conviction, who was arrested for openly carrying a handgun during a 2022 protest. Judge Stephanie Ray’s unanimous panel cited the U.S. Supreme Court’s 2022 Bruen decision, emphasizing historical protections for open carry and rejecting the ban’s constitutionality. Florida Attorney General James Uthmeier supported the ruling. This decision reverses a 2017 Florida Supreme Court ruling and could make Florida the latest state to allow open carry, pending possible further appeals.
